The Buying Process: A Guide for Home Buyers

Purchasing a property is one of the most exciting milestones in your life, but navigating the legal landscape requires clear, up-to-date knowledge. In line with the UK Government’s Home Buying and Selling Reforms and the Digital Markets, Competition and Consumers Act (DMCCA), the property market has shifted toward absolute transparency.

By providing extensive property data upfront, the modern buying process is faster, more secure, and carries a significantly lower risk of sales collapsing.

1What Can You Afford?

Before committing to viewings, you must establish your true purchasing power. The most effective way to do this is by speaking with an independent mortgage broker to secure an Agreement in Principle (AIP) (sometimes called a Decision in Principle).

Having an AIP in hand allows you to view properties with absolute confidence. Furthermore, it places you in a powerful negotiating position; sellers and agents will immediately recognise you as a verified, serious buyer.

2Start Your Search & Review the "Sales Pack"

Once your budget is established, your search begins! In addition to browsing property portals, you can register for instant email alerts on our website to receive real time updates when new homes match your criteria.

The Advantage: Under current UK consumer protection laws, all property listings must display comprehensive Material Information upfront. Before you even book a viewing, you will have access to a digital Sales Pack or Property Logbook detailing:

  • Part A: The exact asking price, tenure details (freehold or detailed leasehold lengths/costs), and the Council Tax band.
  • Part B & C: Physical property characteristics, structural condition, utility connections, broadband coverage, and specific factors like flood risks or restrictive covenants.

This transparent framework ensures you are fully informed before spending a penny on legal or survey fees. Once you spot a property you love, we will arrange a viewing at your earliest convenience.

3Offer Stage

When you find the perfect property, it's time to put your best foot forward and make an offer. To ensure your offer is taken seriously especially if there are multiple interested parties we will submit it alongside your AIP and your verifiable proof of deposit. At this stage, you should also clearly state any special conditions or fixtures you wish to be included in the purchase.

4Offer Agreed

Once your offer is accepted, the transaction formally begins. To comply with strict Anti-Money Laundering (AML) regulations and digital security laws, we will perform quick, secure digital identity checks and verify your source of funds. This unified check ensures you do not face repetitive, time-consuming identity bottlenecks later with lenders or lawyers.

Both parties will then instruct a residential conveyancing solicitor. We highly recommend utilising tech forward, specialist conveyancers who use shared data platforms to accelerate your paperwork. Once legal representation is locked in, we issue a formal Memorandum of Sale to all parties.

5Early Commitments & Digital Conveyancing

Under modern transaction frameworks, buyers and sellers increasingly sign an Earlier Binding Agreement (or conditional contract) shortly after an offer is accepted. This locks in both parties' commitment early in the process and outlines financial penalties if either side pulls out without a valid legal reason effectively eliminating unfair practices like gazumping or gazundering.

Your solicitor will manage the legal transfer of deeds and funds. Because your seller has already compiled an upfront Sales Pack, your solicitor can instantly initiate local authority searches and title reviews without traditional paper based delays.

6Survey and Mortgage Offer

In tandem with conveyancing, if you are utilising a mortgage, your lender will arrange an independent valuation survey to verify the property's worth. However, a lender's valuation is purely for their financial peace of mind.

For your own protection, we always advise commissioning an independent, comprehensive structural survey (such as a RICS Home Survey Level 2 or Level 3). Once your lender reviews their valuation and approves your financial profile, they will issue your formal Mortgage Offer, signalling that your funds are fully secured.

7Exchange of Contracts

Once searches are clear, queries are satisfied, and your mortgage offer is live, your solicitor will send you the final contract for signature.

You will transfer your exchange deposit (typically 10% of the total purchase price) to your solicitor's secure client account via cleared electronic funds. Once a mutually agreed Completion Date is locked in across the entire chain, your solicitors will formally Exchange Contracts. At this exact milestone, the purchase becomes legally binding on both sides.

8Completion Day

Completion day is when you officially take ownership of your new home! On this morning, your mortgage lender will release the remaining funds to your solicitor, who will then electronically transfer the full balance to the seller’s legal team.

The moment the seller's solicitor confirms receipt of the money; completion has taken place. They will notify us to release the keys, and we will call you immediately to arrange for you to collect them from our branch or meet you directly at your brand-new front door!
